HOS Exemptions for Ag Commodities Has Been Approved by White House

The FMCSA’s potential rulemaking to define which drivers are allowed to run under HOS exemptions for agricultural commodities has been approved by the White House’s Office of Management and Budget.

The advanced notice of proposed rulemaking won’t divulge any specific reforms. Instead, it’s intended for the solicitation of comments from industry stakeholders about the definition of an agricultural commodity.

Currently, the FMCSA defines ag commodities as “any agricultural commodity, nonprocessed food, feed, fiber, or livestock,” but that definition could change if the agency proceeds with the rulemaking process.

Once published in the Federal Register, the ANPRM will be open for public comments.
